Please read these Terms carefully before using White Flower Foundation. By accessing the platform, you agree to be bound by them.
1 Acceptance of Terms
By accessing or using the White Flower Foundation platform ("Platform"), available at whiteflowerfoundation.co, you agree to be bound by these Terms of Use ("Terms"). These Terms apply to all visitors, campaign organizers, and donors. If you do not agree with any part of these Terms, you may not access or use the Platform.
These Terms operate together with the following policies, which are incorporated by reference and apply to your use of the Platform:
2 Eligibility
You must be at least 18 years old to make a donation or start a fundraiser on White Flower Foundation. By using the Platform, you represent and warrant that you meet this requirement. If you are under 18, you may only use the Platform under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. We do not knowingly allow children under the age of 13 to use the Platform.
3 Using the Platform
White Flower Foundation is built to be simple and frictionless. You do not need to create an account, register, or set a password to make a donation. To support a cause, you simply choose a campaign, select a donation amount, and complete a secure checkout.
If you create a fundraiser, you provide identifying details (such as name, email, and location) so we can verify the campaign and contact you about it. Because we do not currently operate user logins or donor dashboards, we recommend keeping the confirmation email and receipt you receive after each donation. Campaign organizers may be asked to verify their identity, the details of the fundraiser, and the beneficiary before any funds are released. We reserve the right to request additional information, and to suspend, remove, or refuse to release funds for any campaign in cases of suspected fraud, misuse, or violation of these Terms or our other policies.
4 Campaign Rules
All campaigns created on the Platform must comply with these Terms, our Acceptable Use Policy, and applicable law. By creating a campaign, you represent and warrant that:
- All information you provide is truthful, accurate, current, and not misleading.
- You have the legal right to raise funds for the stated purpose and beneficiary.
- Funds raised will be used solely for the purpose described in the campaign.
- You will keep donors reasonably informed about the progress of the campaign and the use of funds.
- Your campaign does not violate any applicable law, regulation, our Acceptable Use Policy, or the requirements of our payment processor.
We may, at our reasonable discretion and in good faith, suspend, remove, or restrict access to any campaign that we believe violates these Terms or our policies, with or without prior notice.
5 Acceptable Use
Certain types of campaigns, content, and conduct are not allowed on the Platform — including campaigns that promote illegal activity, hate, violence, fraud, intellectual property infringement, regulated or restricted products, or any business or activity prohibited by our payment processor. Violations may result in removal of content, suspension of access, refund of donations, and — where appropriate — referral to law enforcement.
6 Donations
Donations made through White Flower Foundation are voluntary contributions intended to support the cause described in each campaign. Your donation goes directly toward the cause you choose to support. Donations may be one-time or recurring (monthly), processed securely through our payment partner.
By making a donation, you acknowledge and agree that:
- Donations are generally final once processed, as funds may be allocated to the supported cause shortly after your contribution.
- Refunds are limited and reviewed on a case-by-case basis, at our reasonable discretion, as described in the Refund & Cancellation Policy.
- Recurring (monthly) donations can be canceled at any time. Cancellation stops all future charges; donations that have already been processed are not retroactively refunded.
- We do not guarantee any specific outcome, timeline, or result for any campaign, fundraiser, or beneficiary, and we do not guarantee that a campaign will reach its fundraising goal.
- Donations are tax-deductible only where the receiving campaign or organization qualifies under applicable law. We encourage you to consult a tax advisor regarding your specific situation.
We take donor protection seriously. In cases of duplicate charges, an incorrect amount, payment or technical errors, unauthorized transactions, or confirmed fraud or misuse, we will review your request fairly and may issue a refund. If you ever have a concern about a donation, please contact us first so we can resolve it directly — this is usually the fastest way to make things right. 7 Payment Processing
All payments on the Platform are handled by a third-party payment processor under that processor's own terms of service and privacy policy. By making a donation, you also agree to the terms of our payment processor. We do not store full card numbers or bank account details on our servers. We may, at any time and without prior notice, change payment processors, suspend processing, or refuse to process a transaction that we believe in good faith violates law or our policies.
8 Prohibited Conduct
When using the Platform, you agree not to:
- Create false, misleading, or fraudulent campaigns or accounts.
- Harass, threaten, defame, or harm other users.
- Upload or share content that is obscene, hateful, defamatory, or that infringes intellectual property or privacy rights.
- Use bots, scrapers, crawlers, or other automated means to access, copy, or collect data from the Platform.
- Attempt to gain unauthorized access to any portion of the Platform, our systems, or another user's account.
- Engage in any activity that disrupts, overloads, or interferes with the operation, security, or integrity of the Platform.
- Abuse the donation or refund process, including filing fraudulent payment disputes or chargebacks for legitimate donations.
- Use the Platform in any way prohibited by our Acceptable Use Policy or by applicable law.
9 Content & Intellectual Property
All content on the Platform — including the White Flower Foundation name, logos, text, graphics, photos (other than user-submitted content), and software — is the property of White Flower Foundation or its licensors and is protected by intellectual property and other applicable laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of this content without our prior written permission.
By submitting content (such as campaign descriptions, stories, updates, photos, and comments) to the Platform, you grant White Flower Foundation a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, publish, translate, distribute, and display that content in connection with operating, promoting, and improving the Platform. You represent and warrant that you own or have all the necessary rights to grant this license, and that the content does not infringe the rights of any third party.
10 Disclaimers
The Platform is provided on an "as is" and "as available" basis. White Flower Foundation acts as a technology platform that connects campaign organizers with potential donors. We do not endorse, verify the ultimate outcome of, or guarantee any individual fundraiser, beneficiary, or campaign organizer. We do not guarantee that any campaign will reach its goal, that funds will be used as described, or that any specific result will be achieved.
To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
11 Limitation of Liability
To the fullest extent permitted by applicable law, in no event will White Flower Foundation, its officers, directors, employees, volunteers, contractors, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, revenue, data, goodwill, or other intangible losses — arising out of or related to your use of (or inability to use) the Platform, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total amount of donations you made through the Platform in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
12 Indemnification
You agree to defend, indemnify, and hold harmless White Flower Foundation and its officers, directors, employees, volunteers, contractors, and partners from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Platform; (b) any content you submit, post, or transmit through the Platform; (c) your violation of these Terms or any of our other policies; (d) your violation of any applicable law or regulation; or (e) your violation of the rights of any third party.
13 Termination
We may suspend or terminate your access to the Platform — or to any specific campaign — at any time, with or without prior notice, for any reason, including violation of these Terms, our Acceptable Use Policy, applicable law, or for the protection of our community. Upon termination, your right to use the Platform immediately ceases. Provisions that by their nature should survive termination — including Sections 9 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) — will survive.
14 Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state or federal courts located in the United States, and you consent to personal jurisdiction in those courts.
Before initiating any formal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at support@whiteflowerfoundation.co. Many concerns can be resolved quickly and amicably this way.
15 Changes & Contact
We may update these Terms from time to time to reflect changes in our practices, our services, or applicable law. When we do, we will revise the "Last updated" date at the top of this page and, when changes are material, take additional reasonable steps to notify you — such as posting a prominent notice on the Platform. Your continued use of the Platform after the updated Terms take effect constitutes acceptance of the changes.
